Terms of Service
Welcome to TrustFix. These Terms of Service ("Terms") are an agreement between you and TrustFix ("TrustFix", "we", "us" or "our"). They govern your use of the TrustFix mobile app, our website and every related service (together, the "Platform").
By creating an account or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.
1. What TrustFix is
TrustFix is an online marketplace that connects three kinds of users:
- Customers, who are looking for help with home and local services such as plumbing, electrical work, cleaning, painting and repairs.
- Vendors, who are independent professionals offering those services.
- Suppliers, who sell materials and products to vendors.
TrustFix provides the tools that let these users find each other, communicate, agree on work and pay each other securely. We hold payments in escrow and help resolve disagreements, but we are not a party to the agreement between a customer and a vendor, or between a vendor and a supplier. Vendors and suppliers are independent businesses. They are not our employees, agents or partners, and they are responsible for the services and products they provide.
2. Your account
- To use most of the Platform you need an account. You can register with your email address or sign in with Google or Apple.
- You must give us accurate, current and complete information, and keep it up to date.
- When you set up your account you choose whether you are a customer, a vendor or a supplier. This role cannot be changed later. If you need a different role, you will need a separate account.
- You are responsible for keeping your login details secure and for everything that happens under your account. Tell us straight away at laborsoftech@gmail.com if you think someone else has accessed your account.
- You may only create an account for yourself or for a business you are authorised to represent, and you must not transfer or sell your account to anyone else.
3. Vendor and supplier verification
Vendors and suppliers must complete onboarding before they can offer services or sell on the Platform. This includes submitting identity and business documents for review.
We may approve, reject or ask for more information about any application, and we may suspend or remove a vendor or supplier at any time if we have concerns. Verification means that we have reviewed the documents provided to us. It is not a guarantee of the quality, safety or legality of any work, product or person, and customers should still use their own judgement when choosing who to hire.
4. Proposals and projects
Work on TrustFix is always agreed through a proposal:
- A customer finds a vendor or service and discusses the job with the vendor in chat.
- The vendor sends a proposal for one of their services, setting out the scope of the work, the price and, where relevant, the milestones the work is split into.
- If the customer accepts the proposal, it becomes a project. Accepting a proposal creates a binding agreement between the customer and the vendor on the terms of that proposal.
Proposals may have an expiry date, after which they can no longer be accepted. A vendor may revise a proposal that has not yet been accepted, and a customer may decline any proposal.
Vendors must describe their services, prices and timelines honestly, and must carry out accepted work with reasonable care and skill. Customers must describe the job accurately and give the vendor the access and information reasonably needed to do it.
5. Payments and escrow
- Payments on the Platform are made in Nigerian Naira (NGN). You add money to your TrustFix wallet through our payment partner. Card and bank payment details are entered on our payment partner's secure pages; we do not receive or store your full card details.
- Escrow. When a customer funds a milestone (or a one-time project), the money is held in escrow. It is not paid to the vendor at that point.
- Delivery and approval. When the vendor submits the work for a milestone, the customer can approve it, ask for a revision, or open a dispute. The escrowed money is released to the vendor when the customer approves the work.
- Automatic release. If the customer does not approve, request a revision or open a dispute within the review period shown in the app, the milestone is released to the vendor automatically. Please review submitted work promptly.
- Released money is added to the vendor's wallet as earnings. Your wallet balance is not a bank account and does not earn interest.
- Pay through TrustFix. Escrow protection, dispute resolution and payment records only apply to payments made through the Platform. Do not ask for or make payments outside TrustFix for work arranged on TrustFix.
6. Cancellations and refunds
- A customer can cancel a milestone that has not been funded yet at no cost.
- A customer can ask to cancel funded work. Depending on the stage of the project, the cancellation takes effect immediately or needs the vendor's agreement. The app tells you which before you confirm.
- Once work for a milestone has been submitted, the customer should approve it, ask for a revision, or open a dispute, rather than cancel.
- If a vendor cancels a project, any money still held in escrow for that project is refunded to the customer's wallet.
- When a cancellation is accepted, any money held in escrow for the cancelled work is refunded to the customer's TrustFix wallet.
7. Disputes
If something goes wrong with funded or submitted work, either the customer or the vendor can open a dispute from the project. When a dispute is opened:
- The money involved stays in escrow and the disputed milestone or project is paused until the dispute is closed.
- The other party is notified and can respond once with their side of the story and supporting evidence.
- The person who opened the dispute can withdraw it while it is still open.
- The TrustFix team reviews the dispute, including the project details, chat history, deliveries and evidence provided by both sides. We may ask either party for more information.
We then resolve the dispute by refunding the customer in full, releasing the payment to the vendor in full, or splitting the money between them. Please give us accurate information: providing false evidence is a serious breach of these Terms.
Our decision determines how the money held on the Platform is paid out. It does not limit any rights you may have under the law.
8. Supplier orders (MarketMerge)
Vendors can buy materials and products from suppliers on the Platform:
- The vendor pays for an order from their TrustFix wallet when placing it. The payment is held in escrow and is not paid to the supplier at that point.
- The supplier can accept or reject the order. The vendor can cancel an order until the supplier accepts it. If an order is cancelled or rejected, the payment is refunded to the vendor's wallet.
- The supplier fulfils an accepted order and marks it as delivered. The vendor then approves the order, which releases the payment to the supplier. If the vendor takes no action within the period shown in the app, the order is approved automatically.
- Either the vendor or the supplier can open a dispute about an order. Order disputes are handled in the same way as disputes about projects, described in section 7. If a dispute about an approved order is decided in the vendor's favour, the money may be recovered from the supplier's wallet.
- Suppliers are responsible for the accuracy of their product listings, prices and stock, and for delivering what was ordered.
9. Withdrawals
Vendors and suppliers can withdraw available earnings from their wallet to a Nigerian bank account. You are responsible for giving us correct bank details. We may review withdrawal requests, delay or refuse a withdrawal where we reasonably suspect fraud, error or a breach of these Terms, and ask you to confirm your identity before paying out. Money that is still held in escrow or under dispute cannot be withdrawn.
10. Reviews and your content
- After a project or order is completed, customers can rate and review the vendor's service, and vendors can rate and review the supplier's order. Reviews must be honest and based on your own real experience. Do not offer or accept anything in exchange for a review, and do not post fake reviews.
- "Your content" means anything you post or upload, such as profile details, photos, portfolio items, product listings, messages, proposals, deliveries, reviews and dispute evidence. You keep ownership of your content.
- You give TrustFix a non-exclusive, royalty-free licence to host, store, display and use your content as needed to operate, improve and promote the Platform. For example, this lets us show a vendor's services, portfolio and reviews to customers.
- You are responsible for your content and must have the right to share it.
11. Acceptable use
TrustFix has zero tolerance for abusive or objectionable content and behaviour. You must not:
- Post content that is unlawful, fraudulent, threatening, harassing, hateful, sexually explicit, violent, or that invades anyone's privacy.
- Harass, threaten, discriminate against or abuse any other user.
- Give false information, impersonate anyone, or misrepresent your identity, skills, qualifications, business or products.
- Use the Platform to arrange payments outside TrustFix, commit fraud, launder money, or offer illegal services or products.
- Post fake reviews or manipulate ratings.
- Share another user's personal information without their permission, or use it for anything other than the job you arranged on TrustFix.
- Upload viruses or harmful code, scrape the Platform, try to access accounts or systems you are not authorised to use, or interfere with how the Platform works.
12. Reporting and blocking
- You can report any user, profile or content that you think breaks these Terms directly from the app. Our team reviews reports within 24 hours. We may remove content, restrict features, or suspend or permanently remove the accounts of users who break these rules.
- You can also block another user. Once you block someone, you will not see your conversation with them in your inbox, and neither of you can send the other messages or proposals.
13. Suspension and closing your account
We may suspend, restrict or close your account, or remove any content, if we reasonably believe that you have broken these Terms, the law, or put other users or the Platform at risk. Where appropriate, we will tell you why.
You can delete your account at any time from within the app. Before deleting your account, please complete or cancel any active projects or orders and withdraw any available balance. Deleting your account does not cancel obligations you already have to other users, such as work or payments you have already agreed to. We may keep some records after your account is deleted, as explained in our Privacy Policy.
14. Disclaimers
The Platform is provided "as is" and "as available". We work hard to keep TrustFix running smoothly and securely, but we do not promise that it will always be available, uninterrupted or error-free.
Because vendors and suppliers are independent, we do not guarantee the quality, safety, timing or legality of any service or product arranged through the Platform, or that any user will complete a transaction. Our role in disputes is limited to deciding how money held on the Platform is paid out.
15. Limitation of liability
To the fullest extent permitted by law, TrustFix is not liable for:
- any indirect, incidental, special or consequential loss;
- loss of profits, revenue, business or data; or
- any loss caused by the acts or omissions of another user, including the services or products they provide.
To the fullest extent permitted by law, our total liability to you for any claim relating to the Platform is limited to the amount of money held on the Platform for the transaction the claim relates to. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Nigerian law.
16. Indemnity
You agree to compensate TrustFix for any claims, losses or costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or your violation of any law or of another person's rights.
17. Changes to these Terms
We may update these Terms from time to time, for example when we add new features or when the law changes. When we do, we will publish the new version on this page with its effective date, and where the changes are significant we will let you know in the app or by email. By continuing to use the Platform after the new version takes effect, you accept the updated Terms.
18. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute that we cannot resolve informally will be subject to the jurisdiction of the courts of Nigeria.
